HIPAA glossary for ABA clinics

These six terms decide most parent-communication procurement decisions, and they are usually met for the first time in the middle of one. The definitions below are written for a clinic owner with a vendor call in an hour, and each one is checked against the regulation rather than against another vendor’s summary of it.

HIPAA

HIPAA stands for the Health Insurance Portability and Accountability Act of 1996, a US federal law whose privacy and security rules govern how health information may be used, disclosed and safeguarded by healthcare providers and the vendors working on their behalf.

Protected Health Information (PHI)

Protected Health Information is health information that identifies an individual, or could reasonably be used to identify them, when it is held or transmitted by a healthcare provider or one of its business associates.

Electronic protected health information (ePHI)

Electronic protected health information is protected health information that is transmitted or maintained in electronic media, and it is the specific category the HIPAA Security Rule applies to.

Covered entity

A covered entity is a health plan, a healthcare clearinghouse, or a healthcare provider that transmits health information electronically in connection with a transaction such as an insurance claim.

Business Associate Agreement (BAA)

A Business Associate Agreement is a written contract between a healthcare provider and a vendor that handles protected health information on its behalf, setting out how that vendor may use, safeguard and disclose the information.

FERPA

FERPA is the Family Educational Rights and Privacy Act, a US law governing the privacy of education records held by schools and other educational institutions that receive federal education funding.
